PowPaw Terms of Service

1. Who we are

PowPaw is a product of SHURA CAPITAL LLC, a limited liability company organized in the State of Delaware, USA, with its registered address at 1934 Wilson St, Hollywood, FL 33020, USA ("PowPaw," "we," "us"). Contact: support@powpaw.app.

2. Acceptance and age

By creating an account or using PowPaw, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the app.

To create an account or buy a subscription, you must be at least 18, or the age of majority in your country if it's higher. PowPaw isn't intended for minors.

3. The service

PowPaw lets you keep your pets' health records: profile, weight, diet, vaccines, medications, test results, check-ups, expenses and reminders.

• Sharing a pet. You can invite other people by email to view or edit a pet's records, with the permission you choose. Only invite people who agree to receive the invitation. You can remove access at any time.
• Share links. You can create links to specific records, for example to show a vaccine to your vet. Anyone with the link can view it until you revoke it.
• Transferring a pet. You can transfer a pet's records to another account. Once accepted, the other person becomes responsible for those records.
• Contacts. If you add details about your vet or other people, you confirm you have the right to do so and that you use them only for your pet's care.

We may add, change or remove features. If a change takes away something essential that you pay for, we'll let you know in advance.

4. PowPaw doesn't replace your vet

PowPaw is a record-keeping and organization tool. It doesn't provide veterinary services, diagnose, prescribe or replace a visit to a licensed veterinarian. If your pet has any symptom, or if you have a question or an emergency, contact a vet right away. Don't delay your pet's care because of something you saw in the app.

Reminders for vaccines, medications and check-ups are calculated from the information you enter. If something is wrong or missing, the reminder will be too. Your pet's care is your responsibility and your vet's.

AI features

Some features use third-party AI models:

• Document reading: pulls information from the test results, certificates and labels you upload (provider: Anthropic).
• Assistant: answers questions about your pet's records (provider: Anthropic).
• Cartoon: creates an illustration from your pet's photo (provider: OpenAI).

By creating your account, you agree that these features send those providers what they need to work, and nothing more. They're optional: if you don't want to use them, you can enter everything manually and the rest of PowPaw works the same.

AI can make mistakes. It may misread a value, miss information or give an incomplete or wrong answer. Always review what the AI adds before relying on it. The assistant's answers are general information about the recorded data, not veterinary advice.

5. Your account

You're responsible for keeping access to your account secure and for making sure the information you add is accurate. Let us know right away if you think someone accessed it without permission. You can delete your account at any time in the app or at powpaw.app/delete-account.

If you pay through Apple or Google, deleting your account doesn't cancel your subscription. Cancel it in the store, as explained below.

6. Subscriptions and pricing

PowPaw is offered as a monthly or annual subscription. The price depends on how many pets you have in your account:

Accounts in the eurozone pay in EUR, VAT included. Everyone else pays in USD, plus any taxes that apply in their country. Each account can have up to 6 pets; for more, email us at support@powpaw.app. Being a co-parent of someone else's pet doesn't count toward the limit.

If you pay in the app, Apple or Google shows the final price before you confirm, in your currency and with taxes. That price prevails over this table.

• Free trial. 30 days with every feature, once per account. Nothing is charged during the trial and it doesn't turn into a subscription on its own: when it ends, you need to choose a plan to continue.
• Where you pay. In the iOS or Android app, Apple (App Store) or Google (Google Play) charges you. On powpaw.app, payment is processed by Stripe on behalf of SHURA CAPITAL LLC.
• Automatic renewal. Your subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends.
• Canceling. If you paid in the app, cancel from your Apple or Google subscription settings. If you paid on the web, cancel from Subscription & Billing on powpaw.app, in as few steps as it took to subscribe. Either way, you keep access until the end of the paid period.
• Changing plans. If you add pets and move to a higher plan, the change is immediate. If you move to a lower plan, it applies at your next renewal. Before you confirm, we show you what you'll be charged and from when.
• Refunds. Apple or Google handles refunds for purchases made in the app, under their policies; we can't process them. Web payments aren't refundable, except under the right of withdrawal described below or where the law of your country requires it.
• Right of withdrawal. If you subscribe on the web, you can withdraw within 10 calendar days of purchase if you're a consumer in Argentina, or within 14 days if you're in the European Union, as provided by the law of your country. Use the withdrawal button on powpaw.app.
• Failed payment. If a charge fails, we retry it after 3 and 6 days, and access is paused in the meantime.
• Expiration. If your trial or subscription expires and you don't choose a plan, access to your pets' profiles and the assistant is paused. Your data is kept for 15 days after expiration and then permanently deleted, including the pets you were the payment owner for. Co-parents of those pets also lose access, unless another pet parent takes over billing first.
• Price changes. We'll tell you in advance, and the store asks for your confirmation when required. If you don't accept the new price, you can cancel before it applies.

Nothing in this section limits your rights under the consumer protection laws of your country.

7. Your content

The information, photos, documents and messages you add remain yours. You give us a limited, non-exclusive, royalty-free license to store, process and display them solely to provide the service. This includes sending them to the providers listed in the Privacy Policy, including the AI providers. We don't use your content for advertising and we don't sell it.

The license ends when you delete the content or your account, except for the retention periods described in the Privacy Policy.

You confirm that you have the right to add what you add, including third-party information such as your vet's details.

8. Acceptable use

You may not:

• Use PowPaw for anything illegal or to harm other people or animals.
• Upload third-party content you don't have rights to, or offensive, violent or unlawful content.
• Try to access other people's accounts or data, or PowPaw's systems.
• Copy, decompile or reverse engineer the app, except as the law allows.
• Use the app in an automated way (bots, scraping) or resell the service.

If you break these rules, we may suspend or close your account.

9. Intellectual property

The app, its design, its code, the PowPaw brand and its own content belong to SHURA CAPITAL LLC or its licensors. We give you a personal, non-exclusive, non-transferable and revocable license to use the app on devices you control, while you have an active account and follow these Terms.

Cartoons created from your photos are for your personal use.

10. Apple and Google

If you downloaded PowPaw from the App Store or Google Play, that store's terms also apply. For App Store users:

• These Terms are an agreement between you and SHURA CAPITAL LLC, not Apple. SHURA CAPITAL LLC, not Apple, is solely responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for any claims relating to the app, including product liability, failure to meet legal requirements, consumer protection or privacy claims. SHURA CAPITAL LLC handles those claims.
• If a third party claims the app infringes its intellectual property, SHURA CAPITAL LLC, not Apple, is responsible for the investigation, defense and settlement of that claim.
• You confirm that you aren't located in a country subject to a U.S. Government embargo and that you aren't on any U.S. Government list of restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Warranty and liability

PowPaw is provided "as is." We don't guarantee that it will work without interruptions or errors, or that information added by you or generated by AI is accurate.

To the maximum extent permitted by law, SHURA CAPITAL LLC isn't liable for indirect damages, lost profits or data loss. Nor is it liable for decisions about your pet's health made based on the app without consulting a vet. Our total liability to you is limited to what you paid for PowPaw in the 12 months before the claim.

These limits don't apply where the law of your country doesn't allow liability to be excluded or limited, for example in cases of fraud or gross negligence.

12. Suspension and termination

You can stop using PowPaw whenever you want. We may suspend or close your account if you break these Terms, or if we stop offering the service. In that case we'll give you at least 30 days' notice, except for serious breaches, and a way to download your data.

13. Changes to these Terms

If we make important changes, we'll notify you in the app or by email at least 30 days before they take effect. If you keep using PowPaw after that date, you accept the new Terms. If you don't agree, you can cancel your subscription and delete your account.

14. Governing law

These Terms are governed by the laws of the State of Delaware, USA. This doesn't take away the protection of the mandatory consumer protection laws of your country of residence, or your right to bring a claim before the courts or authorities where you live when that law gives you that right.
